Georgia DUI Penalties

In Georgia, if you are caught driving over the legal limit, you will be criminally prosecuted. In most cases, a first, second and third DUI conviction is categorized as a misdemeanor offense. However, fourth DUI convictions are felonies, and, under Georgia state law, any out of state convictions for DUI will be counted as prior offenses. First DUI Conviction: Fines from $300 to $1,000,
jail: from 10 days to 12 months,
license suspension: up to 1 full year,
community service: no less than 40 hours,
mandatory completion of DUI program, clinical evaluation and treatment, possible attendance at a substance abuse program, probation: 12 months and
Georgia SR22 insurance required.
Second DUI Conviction: Fines: $600 to $1,000,
Jail: 90 days to 12 months,
License suspension: 3 years,
Ignition Interlock Device: minimum 6 months,
Community Service: minimum 30 days,
Clinical evaluation/treatment, and possible attendance of a substance abuse program, probation: 12 months and
Georgia SR22 insurance required.
For a third DUI conviction, you are facing increased penalties which include up to $5,000 dollars in fines, up to 12 months in jail, a 5 years driver's license revocation, an ignition interlock device, a minimum of 30 days community service, clinical evaluation/treatment, a declaration of a habitual offender (this is not a good thing), 12 months probation and Georgia SR22 insurance requirement.
For a fourth DUI conviction, you face additional penalties including a minimum of 60 days community service, and 5 years probation. In addition, a fourth DUI offense is a felony.
