An ALS hearing is an administrative license suspension hearing which is heard by the Georgia Department of Drivers' Services following a DUI arrest. Anyone arrested for driving under the influence of alcohol or drugs must request such a hearing within 10 days after an arrest or their license will automatically be suspended. The fee to request such a hearing is $150 and must be accompanied with the request for the hearing or you will lose your right to such a hearing and thus lose your driver's license.
It is in the best interests of anyone charged with a Georgia DUI to be represented by an attorney at the hearing. Not only does skilled counsel help you in reinstating your driving privileges but your attorney can learn beneficial information about your case at such a hearing. He or she will be able to hear and cross-examine the arresting police officer's testimony and evidence, which can reveal important legal factors which can have an impact on the defense strategy undertaken in your upcoming criminal case. Such factors can include whether the officer acted on probable cause when pulling you over, whether he informed you of the consequences of a refusal to take a breathalyzer or other chemical test, whether or not you refused, whether the tests were administered properly with properly calibrated and maintained equipment, and more.
