The state of Texas is famous for its tough laws, and DWI is no exception. One particular distinguishing characteristic between DWI and other crimes is the fact that most people who are convicted of DWI or DUID in Texas and nationwide, are not criminals or people with a previous criminal record. Each state criminalizes drinking and driving, and the legal limit for a driver above the age of 21 is 0.08 percent. If you are caught driving with a blood alcohol concentration above the legal limit, then you face losing your driving privileges from 90 days to 1 full year, from 3 days to 2 years in jail, up to $2,000 in fines (or $10,000 if a child under 15 was in the vehicle), and a DWI surcharge of $1,000 for 3 years or $2,000 for 3 years if the BAC was .16 or higher at the time of arrest. The above penalties are for a first time drunk driving offense in the state of Texas in the absence of aggravating factors. If there was a minor in the vehicle at the time, if you caused property damage, bodily injury or death as a result of drunk driving, then penalty enhancements will apply. Furthermore, refusal to submit to a chemical test under the “Implied Consent Law” will result in having your driver’s license taken away at the scene. Chemical test refusal can ultimately result in a driver’s license suspension. For drunk drivers under the age of 21, the legal limit in Texas is .02 percent, and for commercial truck drivers the limit is .04 percent.
