In some states, when you get involved in a drunk driving accident and you accidentally take the life of a passenger or somebody else as a result, you merely get a slap on the hand and are released back into society, not in Texas; much like all other Texas laws relating to crime and punishment, when you kill somebody because you were drinking and driving, you face harsh penalties.
Under Texas Penal Code Section 49.08, a person is guilty of Intoxication Manslaughter when they: (1) operate a motor vehicle, aircraft, watercraft, amusement ride or assemble an amusement ride in a public place and are, intoxicated, and as a result of that intoxication, cause the death of another person by accident or mistake.
An offense under this section is a felony in the second degree, which is punishable by up to $10,000, anywhere from 2 to 20 years in the state penitentiary and a mandatory driver’s license suspension from 180 days to 2 years.
