Suspected Drunk Driver may escape Homicide Charges after Fatal Accident

A Houston man has been arrested after a fatal pedestrian accident. The incident happened at about 8:00 pm on a recent Saturday night when an autistic boy was walking in the street. The 12-year-old boy had been riding his bike with his family a few hours earlier that evening when he somehow became separated from his family. The family could not find the boy and reported him missing to Houston police. Later that evening the boy was walking in northbound traffic lanes on South Post Oak near Main Street where it goes over a freeway. A man driving a black pickup truck north on Post Oak was unable to avoid the boy and struck him. The driver remained at the scene and emergency services were called to the location. The 12-year-old had suffered severe injuries and was pronounced dead. Police spoke with the driver of the pickup truck and determined that the man may have been intoxicated at the time though reports do not discuss what test was conducted to determine intoxication. He was taken into custody and held on charges of driving while intoxicated. The case is being handled by the District Attorney's Office and he has not been charged with vehicular homicide at this time. The DWI suspect may not be at fault in the fatal accident since, unfortunately, the boy was walking in lanes of traffic on the roadway rather than on the sidewalk.
