NFL Player Sentenced for DUI Offense

Yesterday, a Fresno County, California judge sentenced Cincinnati Bengals team member, Jason Shirley, to 30 days in a work program.  The sentence was delivered after a jury found the NFL defensive lineman guilty of driving under the influence and hit (DUI) and hit and run.   Both the "guilty" verdict and DUI sentence were given yesterday in court.

At the time of his arrest, police report that Shirley had a blood alcohol concentration of .12%.  In California, the legal blood alcohol concentration is .08%. 

Shirley was prosecuted for criminal offenses he committed on October 8, 2007.  On that date, Shirley is reported to have been drunk driving and that is also when he crashed into a Fresno County apartment and left the scene of the crime.

Shirley's DUI defense attorney, Charles Magill, believes that the judge was tougher on his client because they took the case to trial instead of reaching an agreement with prosecutors.
The NFL player's first court case for his DUI offense ended in a mistrial after jurors presiding over the case could not reach a verdict.
