Texas DWI Facts You Should Know

According to the Texas Department of Transportation, someone gets injured or dies in a Texas traffic crash related to alcohol about every 20 minutes. Because of the dangerous connection between drinking and driving, Texas courts take these offenses very seriously. You may wonder how much alcohol is too much. How many beers or alcoholic drinks will translate to a .08 blood alcohol concentration (BAC) on a breathalyzer test? That, of course, depends on your body weight, your gender, what you've eaten, and how long you've been drinking. For example, per the average blood alcohol content calculator, if a 160 pound man drinks 4 beers in 2 hours, his BAC will be .05. If he drinks 4 margaritas in 2 hours, his BAC will jump to .09.
You can be arrested for drunk driving if you demonstrate impairment while operating your vehicle regardless of the BAC you measure on a breathalyzer test. You can also be charged with intoxicated driving if you are impaired by any type of drug, whether prescription, over-the-counter, or a street drug. If an open container is found in your vehicle, you can be fined $500 whether you are a passenger or the driver. If found driving while intoxicated with a minor under the age of 15 in your car, you can also be charged with child endangerment, which carries penalties of up to $10,000 in fines, up to 2 years in jail, and a loss of your driver's license for up to 180 days.
