Man Sentenced to Prison Time for 5th DWI

The incident began when a trooper pulled over a vehicle that he observed to be veering out of its lane on Interstate 45. The driver was 35-year-old M.T. who the trooper said had slurred speech when he went up to talk to him. The report also states that the inside of the car smelled like alcohol. M.T. was asked to exit the vehicle whereupon he stumbled over one of the car's tires. The trooper searched the car and found an open container of alcohol. M.T. denied that it was his or having knowledge that it was in the car. A breathalyzer test was conducted and according to the machine M.T. had a 0.275 blood alcohol concentration; over three times the legal limit of 0.08 percent. The man was taken into custody and then it was discovered that he had four prior DWI convictions in Washington for which he was given probation and then enrolled in a substance abuse program. M.T. was charged with felony DWI involving multiple DWIs and a very high BAC at the time of arrest. He admitted to having an alcohol abuse problem and requested that he be given probation and be put into the substance abuse facility program (SAFP) to address this issue. Numerous friends and family members attended his court appearances and testified that they would help M.T. stay sober. Despite these pleas, the judge sentenced him to four years imprisonment, $2,000 in fines and driver's license suspension for one year.
