Drunk Driver Convicted for Felony Murder

A 27-year-old Texas man was found guilty of causing the deaths of two people in a car accident and sentenced to 30 years in prison. C.H. was accused of driving while under the influence of alcohol and crashing his SUV into a car occupied by a 28-year-old woman and her daughter, 10. J.R. and her daughter were reportedly pulled over on the side of the road because her car had become disabled. C.L. was allegedly speeding and texting on his phone after having a large amount of alcohol. His SUV swerved and struck J.R.'s car while going about 80 mph. J.R. and her daughter suffered fatal injuries and died instantly at the scene. C.L. was reportedly found to have a blood alcohol concentration (BAC) that was almost three times the legal limit of 0.08 percent. He was taken into custody for felony DWI. The usual charge in cases involving a fatal DWI accident is intoxication manslaughter which is punishable by up to 20 years behind bars. In this case, however, prosecutors argued that C.L. should be charged with two counts of felony murder due to his record of four previous drunk driving convictions and the alleged circumstances of that day. It was argued that by drinking two beers plus a bottle of vodka and then getting behind the wheel of his SUV and speeding, C.L. had committed intentional acts which qualify for the murder charges. The jury convicted C.L. of the two murder counts and ordered him to two 30-year sentences to be served concurrently.
