First and Second DUI Penalties in Arizona

In the state of Arizona, it is illegal to operate a motor vehicle with a blood alcohol concentration of 0.08% or greater. If you are a commercial motor vehicle driver, that number goes down to 0.04% and for drivers under 21 years of age, there cannot be any detectable amount of alcohol in their system in order for them to operate a motor vehicle.
In addition, in Arizona, it is prohibited to operate a motor vehicle with any amount of drugs or vapor releasing substances in the system if it impairs the driver to the slightest degree. This means that if there is any amount of illegal drug in the person's body, they cannot by law operate a motor vehicle under the influence of a controlled (illegal) substance. If your driver's license is suspended for drunk driving, you will be required to obtain Arizona SR22 insurance in order to get your driver's license re-instated. In addition, you will be required to carry SR22 insurance for three full years from the date of your license suspension.
First Arizona DUI Offense
- Jail: Up to 10 days
- License Suspension: 90 - 360 days
- The court may require that you purchase an Ignition Interlock Device
- DUI base fine: $250
- Additional fines
Second Arizona DUI Offense
- Jail: 30 - 90 days
- License Suspension: 1 year
- Court ordered Ignition Interlock Device
- DUI base fine: $500
- Arizona DUI Surcharge: $400
- Mandatory completion of alcohol education or treatment program
- Community restitution: minimum 30 days
- Additional heavy fines
