Aggravated and Extreme DUI in Arizona

Everyone is familiar with the first-time drunk driving offense, charged as a misdemeanor in Arizona. A misdemeanor DUI is the most frequent arrest and charge made. Certain circumstances can elevate this charge, however, into something more serious. Under Arizona law, you can be charged with an aggravated DUI, which is a felony, if you are found driving while under the influence of alcohol or drugs with a child under the age of 15 in your vehicle. An aggravated DUI can also be charged if you are found guilty of a new DUI while having two or more prior convictions in any state within the last 7 years, you are found guilty of a DUI while driving with a suspended or revoked license, or you are found guilty of a DUI while being ordered to install an ignition interlock device in your car. All of these felonies are punishable by up to $4,000 in fines and fees, 10 days to 4 months in jail or prison, a 3 year license revocation, and an ignition interlock device requirement.

An extreme DUI is charged when your blood alcohol concentration (BAC) measures .15 to .19 percent. A super extreme DUI is charged in cases where your BAC is .20 percent or more. These types of DUI are misdemeanors unless other circumstances are present. Penalties include up to $2500 in fines and fees, 30 to 45 days in jail depending on your BAC, an ignition interlock device, and possible community service.
