Los Angeles Enacts Stiffer DUI Penalties

New Technology Now Required by Law
Thanks to new legislation passed in July, drivers charged with a DUI offense will have to install an Ignition Interlock Device (IID) in order to remain eligible to drive. This program, established in multiple counties throughout CA, including Los Angeles, targets not only repeat offenders, but also those being charged for the first time. The new law stipulates that a first time offender convicted of a DUI must install the device for a mandatory five months. Repeat offenders will face even stiffer mandatory penalties.
Similar to a Breathalyzer, the IID attaches to a car's dashboard and requires the driver to exhale into it before starting the ignition. The device analyzes the breath to determine blood alcohol content, and will prevent the car from being started if above a set level.
In addition to this feature, the IID periodically requires additional breath checks at random intervals. Though primarily intended to prevent a sober friend from breathing into the IID for the driver, it also ensures that he/she cannot begin drinking after starting the car. If one of these additional breath samples is not provided, the device starts honking the car horn and setting off the car's alarm until the ignition is turned off or a clean sample is provided. The IID also logs the event and sends the information to police. The IID program is set to expire in 2016, giving lawmakers a chance to evaluate the policy and decide whether to expand the program.
