What to Do After a DUI Arrest?

Once you’ve been pulled over or arrested on suspicion of
DUI or
DWI, there are several things you can do to help your situation.
- First and foremost, do not try to flee from an officer as he or she is attempting to pull you over. You will eventually get caught and you will face additional charges for evading police.
- Always be polite and courteous when speaking to an officer.
- If the officer asks you any questions about how many beers you’ve had, where you’re coming from, etc., politely decline to answer until you have spoken with a DUI attorney. Anything you say to the officer can be used against you later.
- If the officer asks you to take one or more field sobriety tests, politely decline. These tests are not legally mandatory, and if you fail it will only give the officer more legal grounds to arrest you.
- If the officer places you under arrest, do not resist or become violent. This will only lead to additional charges and enhanced penalties.
- In the event that you are placed under arrest, it’s best to remain silent until you’ve had a chance to speak with a lawyer.
It’s important to contact a
DUI defense attorney as soon after your arrest as possible. An attorney can advise you as to what you should and should not say, and can investigate your arrest to determine whether or not the police violated your constitutional rights by conducting an
unlawful police stop or by using unlawful interrogation methods.
