DUI Charges Against Suspected Drunk Driver Dropped

The charges against a woman that had been arrested for allegedly driving under the influence in February have been dropped by prosecutors on the case. T.M. was taken into custody at about 4:00 in the morning in early February after a Miami-Dade officer says she failed a field sobriety test. The officer says he saw the vehicle the woman was driving fail to stop at a flashing red light, travelling nearly 50 mph in a 20 mph zone and make an improper right turn. The officer turned on his emergency lights and conducted a traffic stop. Reports don't describe what made the officer suspect that the driver was intoxicated but he asked her to perform a breathalyzer test. T.M. refused to take the test so the officer had her perform at least one field sobriety test. The officer says she failed the test and was subsequently taken into custody. T.M. was represented by her attorney at court recently on the charges and Miami-Dade prosecutors informed the judge that they were dropping the DUI offense charges. T.M. must pay for traffic citations concerning careless driving as well as do 50 hours of community service and complete classes about the dangers of driving while intoxicated but has been cleared of any criminal wrongdoing. Field sobriety tests such as the "walk and turn", "horizontal gaze nystagmus" or "one leg stand" require that an officer make a determination on a driver's intoxication status based on their observation of the individual's physical coordination abilities.
