DUI Defendant Alleges Battery by Prosecutor in Court Room

Assistant District Attorney in Reno Accused of Illegally Restraining Defendant
A public defender representing a client convicted of DUI has filed a criminal complaint against a prosecutor, claiming that he attempted to hold the defendant inside a courtroom inappropriately, even using physical force. The Senior Assistant District Attorney is a former lead prosecutor for the Attorney General of Kansas. According to initial court documents, the Reno County Sheriff's Office has been called in to scrutinize the incident, and a prosecutor from Cowley County has been placed in charge of the investigation.
According to the allegations put forth by the public defender representing the DUI convict, she was defending her client in a Reno County courtroom on October 28th. Her client was convicted of the offense, his third DUI conviction, and was given a jail sentence of 90 days. She was escorting the client out of the courtroom after the sentencing hearing when she alleges the offending prosecutor stood in their path, blocking the doorway.
Attorney from Different County Brought In To Review Case
The prosecutor tried to prevent the pair from leaving the courtroom, she claims, going so far as to physically restrain the DUI defendant, insisting that they wait to leave until an officer could arrive and accompany them both to the jail. Explaining his actions to a fellow member of the district attorney's office, the accused prosecutor says he believed the defendant was trying to flee from justice. He also maintains that he did not touch anyone during the incident.
The Cowley County prosecutor reviewing the case will decide what, if any, disciplinary action needs be taken in light of the accusations. As an outsider from a different jurisdiction, his presence is intended to ensure that there is no bias in the investigation, sources say.
