Houston authorities recently arrested a 49-year-old man and his 48-year-old female passenger after making a traffic stop on FM 1774. The arrest report states that the officer observed the vehicle commit a traffic violation (the specific offense was not described) and so turned on his cruiser's lights and sirens. The man driving the car pulled over without incident and the officer began to speak with him and the woman in the car when he became suspicious that the driver was intoxicated. He also checked out the records of both individuals and discovered that the woman had an outstanding felony warrant in Mississippi. The driver was taken into custody for driving while intoxicated and the woman was arrested in regard to her warrant. The officer inspected the man's vehicle and discovered several drugs including marijuana, hydrocodone, methamphetamine and cocaine. Possession of a controlled substance charges were added to the offenses against the driver. The amounts of the drugs found in the car were not described in available reports but meth and cocaine are schedule 1 substances which generally results in automatic felony possession charges. Talk to a drug crimes lawyer now to make sure your rights are protected after an arrest.
If you have been arrested for driving while intoxicated by drugs then you could be facing the possibility of more severe charges than a first time drunk driving charge. Even if there was no accident involved, the allegations that you had an illegal substance in your system could mean substantial incarceration, fines, probation and driver's license suspension. Additional charges involving drug possession at the time that you were pulled over could also increase the severity of the charges against you. A knowledgeable defense lawyer may be able to prove that the officer did not have sufficient grounds for searching your person or vehicle or for conducting a traffic stop in the first place. Additionally, there may have been a mistake in the tests done to check you for intoxication.
