According to patch.com, the Laguna Beach Police Department has scheduled DUI checkpoints throughout the city for this upcoming weekend. The sobriety checkpoints will be conducted on July 20th between 6:00 p.m. and 3:00 a.m. in hopes of identifying drug and alcohol impaired drivers in areas with a history of drunk driving collisions and arrests.
Orange County DUI checkpoints have become very common. Police departments throughout Orange county recently utilized DUI checkpoints to arrest 78 people for suspicion of driving while under the influence over the fourth of July weekend. Many of those arrested as the result of a sobriety checkpoint are not always convicted and may be able to obtain a case dismissal, reduced charges, or a plea bargain depending upon the circumstances of their case.
Laws Governing Laguna Beach Sobriety Checkpoints
Just like everyone else, police have laws that govern the way in which they fulfill their duties. DUI checkpoints have rules detailing the way in which they need to be operated in order for the evidence gathered during their operation to be considered valid evidence in a court of law. If officers fail to adhere to these rules, those charged and arrested at a DUI checkpoint may have an opportunity to have their case dismissed.
Those facing charges resulting from a DUI checkpoint in California are encouraged to evaluate whether or not the following occurred:
- Was there adequate warning of an upcoming DUI checkpoint?
- Was there a supervising officer on duty?
- Was there any way to avoid the DUI checkpoint?
If the answer to any of those questions was no, you may have a valid defense to avoid conviction for a DUI. Contacting an experienced DUI attorney for a free legal case evaluation will help you determine whether or not your DUI checkpoint was unlawfully operated.
