Biker Arrested at Orange County DUI Checkpoint

Dui checkpoints in Orange County have become quite common. No matter what city you are in, if you have been out drinking on a Friday or Saturday night, there is a reasonable chance that you will have to pass through a sobriety checkpoint. On June 21, 2013, a passing bicyclist quickly realized that Orange County police officers are out in force and are ready to arrest anyone breaking the law while intoxicated.
According to local law enforcement, 530 people passed through the Newport Beach DUI checkpoint at Dover Drive and 16th Street and five people were given field sobriety tests. Of those five, two were arrested on suspicion of driving while under the influence and one was arrested for cycling under the influence.
Laws Concerning Cycling Under the Influence
In 1985, California adopted a new statute to prosecute those who use bicycles while intoxicated. Under California Vehicle Code 21200.5, operating a bicycle is considered different than operating a vehicle, so offenders are not subject to DUI laws. California legislature enacted Vehicle Code 21200.5 to differentiate between DUI and CUI considering that a person driving under the influence is more likely to inflict harm and cause damage than one who operates a bicycle while under the influence.
Why Cycling under the Influence is So Dangerous
Some people struggle to understand why cycling under the influence is a danger to society. According to the National Highway and Traffic Safety Administration (NHTSA), twenty four percent of all cyclist fatalities involved a person operating a bicycle who was under the influence. Unlike driving under the influence, cycling while under the influence is far more dangerous for the person who is intoxicated.
