Penalties for Multiple DUI

It is important to understand what you may be facing if you have been arrested for driving under the influence with a prior DUI conviction on your record.  Subsequent charges can greatly impact your life as the penalties increase with each additional conviction.  The following information may be useful if you or a loved one has been arrested for multiple DUI.

 A first or second DUI may be a misdemeanor offense if there are no aggravating circumstances.  The penalties for a simple second DUI include mandatory jail time-up to 96 hours-as well as a driver's license suspension, fines and fees, probation, community service, and installation of an ignition interlock device.  A third DUI conviction can result in up to 120 days in county jail, $2,800 in fines and fees, and a driver's license suspension for three years.  When it comes to a third DUI (or greater), the penalties are significantly more harsh.  Every case depends on the exact circumstances of that particular situation so speak with an Orange County DUI lawyer regarding your case right away.

Felony charges are brought against an individual arrested for a fourth or greater DUI.  This means one year or more in state prison and hefty fines.  Additionally, he or she may be required to attend a substance abuse program, contribute with community service and be punished with a lengthy driver's license suspension and probation period. 

Multiple DUI and California's Three Strikes Law

California's Three Strikes law makes it possible for anyone with two prior felonies on their criminal record to receive an automatic prison sentence of 25 years to life.  This means that if an individual has two prior felonies for DUI and is convicted for a third, he or she could be sent to state prison for life.  The prior felonies do not need to be serious or violent.  Two prior shoplifting felony convictions plus a fourth DUI could mean prison time.
