What Happens After Being Charged with a DUI?
The first action that has to be taken after a person has been charged with a DUI is to set up a DMV hearing within a 10 day period of time. The arresting officer will serve you with what is called a "Notice of Suspension" informing you of your right to schedule a DMV hearing. The purpose of the hearing is to determine what to do about the suspension or revocation of your driver's license. If you fail to set a hearing with the DMV within this 10 day period, you forfeit your right to contest the suspension, even if you are not guilty. The length of time for suspension or revocation depends largely on what evidence was found by law enforcement officials when you were arrested .The hearing is a separate matter from appearing in court and can often be handled by an attorney without you being present.
