Michigan’s Super Drunk Driving Law

Going into effect on October 31, 2010, Michigan's new law regarding drunk driving upped the consequences for those convicted of driving with a blood alcohol concentration (BAC) of 0.17 percent or more. The legal limit in the state for driving while under the influence of alcohol is a BAC of 0.08 percent. Those with the "super" BAC listed above face enhanced penalties, license sanctions, and are required to complete a one-year program of alcohol rehabilitation. The rehabilitation program may consist of a treatment program or a self-help program. The stiffer penalties apply only to first-time offenders who have not been convicted within the last seven years; the penalties for repeat offenders remain the same under Michigan law, which are even harsher than for first-timers.
The maximum number of jail days for someone convicted of Super Drunk Driving is almost double that of those convicted with a lower BAC, up to 180 days. The driver's license suspension is for one year with the first 45 days called a "hard suspension," meaning that no driving will be permitted whatsoever. After that, restricted driving privileges are allowed only for those who have an ignition interlock device installed in their vehicle at their own expense. Those who attempt to drive or actually do drive with a BAC of 0.025 percent while on a restricted license in the Super Drunk Driver category or who violate any of the restrictions placed on them will be subject to another year of license sanctions. Super Drunk Drivers are also subject to increased fines, between $200 and $700 as opposed to $100 to $500 for lower BAC drivers.
