Under the state of California's "implied consent law," you are required to submit to a chemical test when a law enforcement officer asks you to do so. When you apply for your driver's license, you are agreeing to submit to such chemical test if you are under suspicion for drunk driving. There are two main chemical tests that law enforcement uses. They are the breath test, which is accomplished by using a breathalyzer and a blood test. Urine tests are seldom used these days, unless the police officer has reason to believe that you may be under the influence of drugs and/or alcohol. In most cases, if you have been stopped for suspicion of DUI, you will be asked to breathe into a breathalyzer machine. Although these machines are highly reliable, they are not fool proof. Persistent heartburn and dental issues can produce a false reading on the machine.
Blood testing is usually the most accurate type of BAC testing, however, like anything in this world; it is prone to human error. Simple contamination from the alcohol swab used to clean the site for the blood draw, can compromise the blood sample. In addition, only one sample of blood is drawn, if there is a problem with that blood sample, the prosecution can have a tough case to prove.
