Misdemeanors Lead in Arizona DUI Arrests

In a news release posted by the Arizona Governor's Office of Highway Safety in December of 2010, 2,760 DUI arrests were made throughout the state between Thanksgiving and Christmas. Of these arrests, 2,507 were misdemeanors. You can be charged with a misdemeanor in Arizona under 3 laws: for driving under the influence of alcohol or drugs, having a blood alcohol concentration of .08 or higher within 2 hours of driving, or having a blood alcohol concentration (BAC) of .15 or more within 2 hours of operating a vehicle. In many cases, you will be charged with two offenses, driving under the influence and driving with a BAC of .08 or above.
Even if your BAC is below .08, you can still be convicted of driving under the influence if law enforcement observes your ability to drive as being impaired. Furthermore, if your BAC measures .15 or above, you can be prosecuted and convicted for all 3 charges, driving while under the influence, having a BAC of .08 or more, and a BAC of .15 or above. The penalties you face will be based on your charges, your previous conviction history, if any, and other circumstances, such as if you caused an accident or injury due to your impaired driving.
