The Mechanics of DUI Blood Tests

If you are pulled over by a police officer under suspicion for DUI, you will be asked to perform a series of field sobriety tests and submit to a chemical test. In most cases, that chemical test will be in the form of either a urine test or a breathalyzer test, however in some instances, you may be asked to submit to a blood test in order to determine your blood alcohol concentration (BAC) level. Like blood tests done in a lab, a sample of the person's blood is taken by qualified personnel. Blood tests are not usually taken at the scene, since only a person qualified in withdrawing blood can perform the test. However, blood tests are usually quite accurate, as they can detect traces of different substances the person has ingested.
Challenging the Accuracy of Blood Tests
Even though blood tests are known to be reliable, the possibility of human error in any form of testing cannot be ignored. There are numerous ways a blood test can be challenged in a DUI investigation and even when the blood test is in fact given by a qualified individual, errors can still occur. A qualified Los Angeles DUI attorney can challenge:
- If the person performing the blood test was qualified to do so
- If the blood test was administered properly
- If the blood was transported properly
- If there was a break in the chain of custody
- If the blood test kit was expired
There are a number of defenses that an experienced DUI attorney can use in court. If you or someone you love has been accused of DUI in Los Angeles or the surrounding areas, a Los Angeles DUI lawyer from Gold & Witham can help.
