Council Member Won’t Face DUI Charges

According to Alameda County prosecutors, an Oakland City Council member who failed a field sobriety test in a routine traffic stop in December, will not face DUI charges.
The District Attorney Nancy O'Malley's office decided not to pursue DUI charges against council member Ignacio De La Fuente due to insufficient evidence. According to the DA's office spokeswoman, Teresa Drenick, says that the blood alcohol evidence in the case couldn't not support that De La Fuenta's BAC was over the legal limit when he was pulled over on December 23.
According to the California Highway Patrol, a police officer pulled De La Fuente over on Interstate 580 after he recorded his vehicle traveling 80 mph in a 65 mph zone and making unsafe lane changes.

In California, it is illegal to operate a motor vehicle with a blood alcohol concentration of .08% or greater.
