10 Questions Your DUI Lawyer Should Ask

If you have been arrested for DUI (driving under the influence) there are 10 key questions that your lawyer should ask when challenging your charges:
- Was there probable cause for you to be pulled over to the side of the road in the first place?
- Were field sobriety tests administered properly?
- Did an external factor (physical injury, illness, nervousness, etc.) impact your performance on field sobriety tests?
- Did the officer have probable cause to arrest you for suspected DUI?
- Was your breath test or blood test administered properly?
- Was your breath or blood test administered by a trained professional?
- Was the breath test device calibrated and maintained in accordance with state standards?
- Is there a non-alcohol related explanation to a high breath or blood test result?
- Was the testing of your blood sample accurate?
- Were you lawfully arrested?
These are actually only a portion of the important questions that an attorney can ask when handling drunk driving charges on a client's behalf. Asking these questions may bring serious evidentiary or procedural violations to light, turning the tide in the defendant's favor.
Even if you were arrested for DUI and took a breath test or blood test that showed a high result of more than .08%, this does not mean that A) you are guilty or B) that you should be found guilty of DUI.
