The Denver Post has reported that a man accused of causing the death of a teen in a DUI-fueled car crash, may be charged with first-degree murder because it is not his first drunk driving offense and he's never obtained a driver's license in the United States.
E.O.G.'s criminal history dates back to 2000 and includes two charges of DUI before his most recent offense. Almost 50 percent of his arrests occurred when he was living illegally in the United States. While in Colorado he never secured a license to drive, however, it did not stop him from getting behind the wheel.
E.O.G. is a native of Mexico.
In his current arrest E.O.G. is facing six counts that include first-degree murder with extreme indifference. He had been speeding through a red light on East Colfax Avenue when he crashed his Ford Expedition into a Chevrolet Camaro driven by J.D.P.
According to the arrest affidavit E.O.G.'s blood alcohol was over four times the limit to drive. The officer that saw the accident occur claimed to have never seen any brake lights flash on E.O.G.'s vehicle. The officer said that E.O.G. drove so fast he didn't have time to turn on his lights or sirens. He was trailing E.O.G. from a distance of four blocks before he arrived at the scene of the collision, and watched as E.O.G. tried to get out of his smashed up car.
In 2000, after E.O.G.'s first DUI in Douglas County, he failed to appear at his hearing. He was given a 180-day jail sentence for pleading guilty to a lesser charge.
In 2002 E.O.G. pleaded guilty to driving without a license in Arapahoe County.
In 2007 he was arrested for his second DUI in Douglas County. In that case he was ordered to serve a two-year probation.
There is one more case against E.O.G., yet to be resolved, involving driving without a license.
E.O.G. has received only one sentence, which ended with less than a year behind bars, and the Immigration and Customs Enforcement, ICE, was alerted only one time for one of his arrests.
According to Sgt. Ron Hanavan, a spokesman for the department, after his second DUI sentencing E.O.G. turned himself in to the Douglas County Sheriff's Office for an outstanding warrant.
E.O.G. has appeared in the Arapahoe District Court, handcuffed to a wheel chair and both of his legs in casts. Due to the murder charge he faces a possible life sentence in prison.
The public has been watching the case and debates have grown over harsher punishments and better regulations – in regards to people that choose to get behind the wheel of a car without a driver's license, and people that have had repeat DUI offenses and are still on the road.
