Fight Your DUI Blood Test

If you submitted to a DUI blood test, there are ways to fight the results.
Certain issues can arise that make the results of your blood test inadmissible in court. If you can prove that fermentation occurred in the test tube holding your blood, the court will not be able to determine an accurate blood-alcohol level in your case. In addition, if clotting, coagulation or contamination can be proved, the results of your blood test are more likely to be dismissed.
If none of those are present, there are still more options. Your lawyer can determine whether the chain of custody was broken, if the blood test itself was administered improperly, if an unqualified blood test analyst studied your results, or if there was a failure to comply with Title 17. Although these may be more difficult to prove, they have been used in the past to dismiss DUI charges.
