What Happens after a DUI Arrest in California?

If you have recently been arrested on DUI charges you might be wondering what happens next. Although this can be a scary period in your life you can get through it with knowledge of the system and a qualified criminal law attorney.

The officer who arrested you is required by law to forward a copy of your license revocation or suspension form, as well as your license if taken into possession, and a sworn report to the DMV. The DMV will then conduct an administrative review of the officer's report, the revocation order and any test results if taken during the DUI arrest.

If the suspension is upheld after the administrative review, you have the right to contest it. You also have the right to request a hearing within ten days of receiving the suspension order. Should the review show that there was no reason for suspension of your license then the order will dropped. You will then be notified by the DMV in writing if you are successful in cancelling the suspension.
