A woman that killed a cyclist at approximately 9 p.m. on September 11, 2010, during a dui methamphetamine binge, pleaded guilty to DUI, and wasn't charged for murder as the cyclist crossed in front of her car and the bike didn't have a light on it, as reported by The Ramona Sentinel.
S.N.R., 33, was sentenced to 90 days in jail and taken immediately into custody on November 29. She has been jailed at Las Colinas Women's Detention Facility.
S.N.R. is expected to be released from the facility on January 28, 2012.
Deputy District Attorney, Andrew Aguilar, told El Cajon Superior Court's Judge Sharon Majors-Lewis that his office had concluded that the actions of cyclist, D.B.M, 54, "were definitely the primary cause for the collision" and that "he crossed in front of her. He violated her right of way. She veered right to avoid him."
After driving her Toyota 4Runner into D.B.M., S.N.R. then ran into a stop sign and a Volkswagen that was parked near the entrance of a liquor store. The impact sent the Volkswagen into the front entrance of the store.
Two people were injured in the Volkswagen and were treated for pain. Another victim, the cashier inside the liquor store, was taken to a nearby hospital for injuries sustained from flying debris.
Joseph Bryans, S.N.R.'s attorney, said, "The bicycle came out in front of her."
Prosecutors considered charging S.N.R. with vehicular manslaughter but was "not able to go forward" once they learned that D.B.M. had entered the path of the 4Runner and that his blood alcohol level the night of the accident was .17 percent.
S.N.R. was charged with two misdemeanor meth counts this August. She pled guilty to both: a count of using methamphetamine and driving under the influence of methamphetamine.
Majors-Lewis imposed a 90-day jail sentence - all but 90 days had been suspended from a one-year jail term - five years of probation, payment of a $2,500 fine, and the completion of a multiple conviction program.
As S.N.R. was on probation already when the new DUI occurred, the judge imposed the fine, revocation of her probation and ordered her to take the program for multiple convictions.
The judge further imposed that the new 90-day sentence be run concurrent with the other 90-day sentence.
The fine imposed on the earlier case, from 2008, was still yet unpaid - court records showed that collection proceedings had begun for the fine of $1,605.
After completing the 90 days in jail it is expected that S.N.R. will be returned to Texas where authorities will oversee her probation, as she had moved there from El Cajon after the accident. Her defense attorney stated that the transfer of her probation to Texas will be gone over at an upcoming January 31 hearing.
