In Nevada, lawmakers have decided that drivers in Nevada need to fail only one of two required sobriety tests before his or her license is yanked for drunken driving. Nevada law requires that two breath tests be taken on a suspected drunken driver to determine BAC. A lower court ruled that the driver must fail both tests before a license can be revoked. But the Nevada Supreme Court has now ruled that only one test must be failed to revoke a license.
