New Mexico Court Rules on Driving in DUI

The New Mexico Supreme Court has ruled that driving under the influence of alcohol charges require proof of driving or intent to do so. The court reversed an interpretation that had discourage drivers from sleeping off a night of drinking in their vehicles. The court believes that those who are arrested for DUI based on "actual physical control" of the vehicle must be shown to have intended to drive rather than sleep off the alcohol in their system.
