Yes, you can appeal a DUI case if you believe that you were wrongly convicted because of mistakes or errors during your trial. Proving these errors can be difficult and can involve complex laws and legal guidelines. You only have sixty days to file an appeal after a judgment in your case has been finalized, and it is important to seek the help of a DUI lawyer as soon as possible. Some of the reasons why you may want to appeal your DUI case include being found guilty even though there was a lack of evidence and if evidence was used against you that should not have been admitted to trial. You can also appeal your conviction if you feel that the prosecution withheld evidence or that your constitutional rights were violated. You also have the right to appeal your DMV hearing if you were unsuccessful in fighting an automatic suspension of your driver’s license.
